Terms of Trade: User-friendly Summary

What We Do:

  • The NZ Session Collective is a pioneering platform in New Zealand dedicated to linking people with top-tier musicians for diverse events and performances such as private events, weddings, corporate events, concerts, festivals, and studio recordings.

Service and Payment:

  • Each booking will have a Service Agreement that outlines the details of the job. Full payment is required at the time of booking. If a payment is late, additional fees apply.

Cancellation Policy:

  • You can cancel your booking in writing. If you cancel more than 5 days before the event, we'll refund your payment minus a 15% admin fee. Cancellations within 5 days of the event will receive a 30% refund (also less a 15% admin fee).

Intellectual Property and Royalties:

  • Copyright of music produced remains with the original copyright holder. Musicians won’t receive royalties for studio recordings unless specified in the Service Agreement - or separately in writing.

Conflict Resolution:

  • We'll always try to resolve disputes through mutual negotiation. If this doesn't work, we may proceed to mediation or arbitration.

Privacy and Confidentiality:

  • We respect your privacy and protect your personal information in accordance with NZ privacy laws. We'll keep business operations and sensitive third-party information confidential.

Liability:

  • Our liability for damages is limited to the total fee you paid for the service. We are not liable for indirect or consequential losses.

Health and Safety:

  • The NZSC agrees to uphold high health and safety standards. Clients should provide a safe and respectful environment for musicians.

Force Majeure:

  • Neither party is responsible for non-performance due to circumstances beyond their control, such as natural disasters or pandemics.

Music and Public Performance Licences:

  • Clients are usually responsible for securing necessary music and public performance licences for events or recording projects, where required.

Non-Exclusivity Clause:

  • Agreements with us are non-exclusive. Musicians are free to offer their services to other clients and participate in other professional activities.

AI Policy:

  • We may use AI technologies to enhance service delivery. We commit to ethical use of AI and will address any related concerns raised by clients or musicians.

Additional Provisions:

  • Open communication about specific needs, requests, or conditions is essential. If unforeseen circumstances arise, they should be handled fairly, potentially including renegotiating certain terms or compensation.
