Terms of Trade Summary

By engaging our services, you agree to the following terms, which govern your booking with us.

1. Our Services
NZSC operates Locrian, an innovative mobile-based music booking app connecting clients with New Zealand’s top musicians and ensembles. Each booking is covered by a unique Service Agreement that outlines specific details like schedule, payment, and expectations.
2. Payment Terms
Full payment is due at booking to secure services. We accept credit card, bank transfer, and cryptocurrency (fees may apply).
Late payments incur a 1.5% monthly fee. Deposits are non-refundable beyond our cancellation terms.
3. Cancellations
Over 5 Days’ Notice: Full refund, less a 15% fee.
Within 5 Days: 50% refund, less a 15% fee.
Within 48 Hours: No refunds.
If a booking must be cancelled due to Force Majeure (e.g. natural disasters), cases will be reviewed fairly for all parties.
4. Intellectual Property
Musicians retain rights to their recorded or live performances. Unauthorised recording, reproduction, or distribution of any live performances is prohibited. Legal action may be taken if such recordings are misused.
5. Dispute Resolution
We aim to resolve disputes through mutual negotiation. If necessary, matters may go to mediation, arbitration, or court in New Zealand.
6. Confidentiality
Both NZSC and the Client agree to keep engagement details confidential. Disclosure is only allowed by law or for fraud prevention.
7. Liability
NZSC’s liability is limited to the service fee paid. We are not responsible for indirect damages or disruptions caused by third-party services, such as payment processors or calendar systems.
8. Health and Safety
Clients must ensure a safe environment for musicians. If safety concerns arise, NZSC reserves the right to cancel without a refund. We recommend carrying public liability insurance for events.
9. Independent Contractors
Musicians booked through NZSC are independent contractors and are not employed by NZSC or the Client.
10. Music and Performance Licences
It is the Client’s responsibility to ensure compliance with all music licensing requirements for public performances or recorded content use. Using NZSC’s branding or musicians in promotions requires prior approval.
11. Privacy
We protect the privacy of our clients and musicians in compliance with New Zealand privacy laws.
12. Artificial Intelligence (AI)
NZSC may use AI to enhance service delivery. We follow ethical AI practices and regularly review our policies to ensure compliance with new developments.
13. Amendments & Breaches
Any amendments to these Terms require written agreement. Either party may terminate the agreement in the event of a breach.
